Survey Prize Draw - Terms and conditions

1. This is a free survey prize draw (“Prize Draw”) organised by Bloomon UK Limited ("bloomon") .

2. This Prize Draw is open to residents of the UK and EEA aged 18 or over who are registered customers of www.bloomon.co.uk who have been selected for this Prize Draw and have received an email on behalf of bloomon inviting them to participate ("Survey Participation Email"). To enter the Prize Draw you must have a valid email address and UK or EEA postal address. Employees of Bloom & Wild Group, their agencies, their family members or anyone professionally associated with this Prize Draw are not eligible for entry.

Please note: only the original recipients of the Survey Participation Email will be eligible for the Prize Draw. If you did not receive the Survey Participation Email, but still are a registered customer of www.bloomon.co.uk, you will not be entered into the Prize Draw.

3. Entrants can enter the Prize Draw draw by completing the entire survey. The closing date for entry to the Prize Draw draw is 14 days after receipt of the Survey Participation Email. Only one entry per person is permitted and a separate entry is required for each person. There will be a number of winners who will be drawn at random from all eligible entries received (“Prize Winners”).The number of possible Prize Winners per Prize Draw is mentioned in the Survey Participation Email. The Prize Draw will take place within 14 days of receiving the Survey Participation Email.

4. Each Prize Winner will be selected to receive an e-gift voucher redeemable at one of a selection of online retailers  (“Prize”). Expiry dates and redemption terms for the e-gift voucher vary per retailer - this information will be made available when the e-gift voucher is claimed by the Prize Winner.

The value of the Prize is stated in the Survey Participation Email. The Prize will be fulfilled via Tremendous.com. All additional costs and expenses associated with the Prize shall be at the expense of the Prize Winner.

5. The Prizes are strictly non-transferable and non-refundable, and no cash alternative will be offered.

6. In the unlikely event that the Prizes are not available or become unavailable through no fault of bloomon, bloomon reserves the right to substitute Prizes which it determines of being of equal value.

7. The Prize Winners will be notified by bloomon by email where correct information has been supplied upon survey entry. Winners must respond to the notification email within 14 days of it being sent (or the time frame indicated in the notification email, if longer than 14 days). If a Winner fails to respond to the notification email within the stated time frame, then that Potential Winner may be disqualified and will forfeit any claim to any Prize(s) and a different Winner will be selected instead. 

8. The Prize will be sent to the Prize Winner by email. bloomon cannot take responsibility for emails not received by the Prize Winner for any technical or other reason.

9. No responsibility is taken for survey entries that are incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.

10. A promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter, bloomon will send the surname and county of the Winner, to anyone who writes bloomon, enclosing a stamped addressed envelope to: Attn: Bloomon Research Team, Bloom & Wild Group, 1-45 Durham St, London SE11 5JH, after the closing date. If you object to any or all of your surname, county and winning entry being published or made available, please contact bloomon at [email protected]. In such circumstances, bloomon must still provide the information and winning entry to the Advertising Standards Authority on request.     

11. Your personal data will be processed in accordance with the bloomon Privacy Policy. Your personal data will be used by bloomon in connection with, and in order to determine the Prize Winner of the Prize Draw (including making available on request the Prize Winner’s name and county of residence, to anyone who wishes to obtain it). bloomon will do this on the basis of its legitimate interests in enabling bloomon users to participate in prize draws. 12. bloomon makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any promotion or the Prize Draw. 

bloomon shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage, however arising, suffered by the entrant resulting directly or indirectly from entry to this Prize Draw. Nothing in these terms shall limit bloomon’s liability for death, personal injury or fraud. 

bloomon will not be responsible for any third party's performance or failure to perform any services related to any promotion and/or the Prize Draw, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Prize Draw, provided that nothing shall limit bloomon's liability for death or personal injury caused by its negligence. 

bloomon does not accept, and is not responsible for, any lost or delayed entries. bloomon reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Prize Draw. 

Although bloomon will use reasonable efforts to ensure that all information relating to the Prize Draw ("Prize Draw Material") is accurate, bloomon is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect bloomon's operation of the Prize Draw, including without limitation the accuracy of any Prize Draw Material.

13. The official rules of the Prize Draw are contained in these Survey Prize Draw Terms and Conditions. By participating, entrants accept these Terms and Conditions and understand that the results of the Prize Draw are final in all respects. All decisions regarding any aspect of this Prize Draw including, but not limited to, Winner selection, will be made by bloomon, whose decisions shall be final and binding in all respects and no discussion will be entered into. Any entries not complying with these official rules will not be accepted and will not participate in the Prize Draw.

Any attempt to manipulate the Prize Draw is prohibited and will result in exclusion from participation.

If bloomon has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, bloomon reserves the right to disqualify that entrant and any related entrants.

bloomon reserves the right to disqualify participants who do not comply with these Survey Prize Draw Terms and Conditions or with the bloomon Terms and Conditions and/or any other bloomon policies.

14. bloomon reserves the right to hold void, suspend, change or cancel the Prize Draw at any time.

bloomon may carry out this Prize Draw through its local subsidiaries. bloomon may use third parties to facilitate one or more elements of the Prize Draw and we may provide some of your personal information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced bloomon related operation.

These Terms and Conditions are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these terms and conditions.
